Term:  Testamentary Capacity

Testamentary Capacity—Persons making wills must have legal capacity. They require ability to legally make valid wills. They must know who should and will benefit from their estate. Courts must be satisfied persons making wills had testamentary capacity to make wills and were not vulnerable to undue influence.
