Term:  Summary Judgment

Summary Judgment—some matters can be adjudicated without a trial. Judges can, on motion before trial, review credibility, evidence and make just decisions if there is no genuine issue requiring trial. Summary judgment motions are complex and require parties put their best foot forward as judges can dismiss claims or defences in summary fashion.
