Family Law Election—only Ontario married spouses have rights to make elections within six months of their married spouse’s death. Surviving married spouses can elect to accept (a) what they receive in wills or (b) their intestate share or (c) what they could receive in the event of divorce. You can’t distribute assets within the first six months of a married spouse’s death without court order or surviving married spouse’s consent.
