To succeed at mediation, make sure you and your lawyer are prepared. Have your pre-mediation meeting before your mediation date. Here is a checklist to use before you attend your pre-mediation meeting.

Checklist of Ten Things for Your Pre-Mediation Meeting

Your lawyer has reviewed with you all legal research on the merits of your case.

You and your lawyer are familiar with the points of law that are in your favour and those against your position.

You have obtained information and records from hospitals, doctors, witnesses, and statements and lawyers’ files.

You’ve assessed the merits of your case to develop a strategy for success.

You have a valuation of assets that are in dispute.

You have an estimate or idea of what it will cost to continue fighting in court.

You have developed a just offer and counteroffer strategy.

You have set realistic expectations for compromise.

You plan to stick to your agenda.

You are flexible and believe the process can work in your favour.

Mediation offers you a shortcut to resolve your estate dispute. You need a positive attitude to resolve your dispute. If you are still angry and upset, you’ll have difficulty thinking clearly.
