Elder Abuse Under Powers of Attorney in Ontario
Kerry had her father’s property power of attorney and handled his finances
once he moved into a nursing home. When her divorce settlement costs grew to more than she anticipated, Kerry felt she could borrow money from her father’s account.
A year later Kerry’s drinking got her fired from her job. She needed financial help and a holiday. She helped herself to what she wanted out of her father’s investment account. She felt entitled to take an early inheritance.
There are a number of problems with Kerry’s approach. Kerry was taking advantage of her father. She was in a conflict of interest over the joint account with her father. Kerry ignored her fiduciary duties. Kerry was supposed to protect her father’s money. Instead, she fleeced him.
The law requires Kerry to invest her father’s money prudently after getting investment advice. She is liable for the theft of the father’s money and loss of profit from his investments.
